These Terms & Conditions ("Terms") outline the expectations, boundaries and responsibilities for all clients engaging with Blue Conker services, including Roots to Rise coaching, online courses, workshops, hypnotherapy, Defrazzle Sessions, Roots to Rise Walks and digital resources.
By purchasing, enrolling in or attending any Blue Conker service, you confirm that you have read, understood and agreed to these Terms.
1. GENERAL EXPECTATIONS FOR ALL CLIENTS
1.1 Commitment to the Work
The work we do together is collaborative.
Whilst I bring my knowledge, experience and professional expertise, lasting change depends upon your willingness to engage with the process, remain curious, take responsibility for your choices and integrate what you learn into your everyday life.
Personal development, coaching, hypnotherapy and subconscious transformation are not passive experiences. Outcomes cannot be guaranteed, as every person's journey is unique.
1.2 Therapeutic Boundaries
Blue Conker provides coaching, education and wellbeing services.
These services are not a replacement for medical care, psychotherapy, counselling, psychiatric treatment or crisis intervention.
If, at any point, I believe another professional or specialist service would better support your needs, I reserve the right to recommend an appropriate referral.
1.3 Respect & Inclusion
Blue Conker operates a zero-tolerance approach towards harassment, discrimination, bullying or abusive behaviour.
I am committed to creating spaces where people feel able to show up without judgement or the need to perform.
My practice welcomes people from all backgrounds and identities, including LGBTQ+ communities, neurodivergent individuals and those who identify as outliers or have spent much of their lives masking, adapting or shape-shifting to fit into environments that never truly felt like home.
1.4 Confidentiality
Everything discussed during coaching sessions, hypnotherapy sessions and submitted coursework will remain confidential except where disclosure is required by UK law.
This includes, but is not limited to:
• risk of serious harm to yourself or another person
• safeguarding concerns
• prevention or detection of serious crime
• where disclosure is otherwise required by law.
2. HEALTH, SAFETY & CONTRAINDICATIONS
2.1 Looking After You
Your wellbeing is always my priority.
Some Blue Conker services include coaching, hypnotherapy, guided relaxation, meditation, visualisation, breath awareness, journalling, creative activities and nervous system regulation techniques.
To help me provide the safest and most appropriate experience possible, please let me know before participating if any of the following apply to you.
2.2 Health & Suitability
Please tell me if you:
• are currently experiencing a significant mental health crisis
• have recently experienced psychosis, mania or another severe psychiatric illness
• are receiving support from a Psychiatrist or Community Mental Health Team
• have epilepsy or another seizure disorder
• are pregnant and have been advised to avoid certain relaxation or hypnotherapy techniques
• have significant sensory sensitivities that may require reasonable adjustments
• have a neurological condition that may affect your participation
• are taking medication that significantly affects your awareness or ability to participate
• have any other medical or psychological condition that you believe I should know about before we begin working together.
Providing this information does not automatically prevent you from working with me.
It simply allows me to discuss reasonable adjustments, determine whether a service is appropriate and, where necessary, recommend a more suitable form of support.
2.3 Alcohol & Recreational Drugs
Please do not attend any Blue Conker service whilst under the influence of alcohol or recreational drugs.
If I reasonably believe you are under the influence, I reserve the right to refuse entry or discontinue the session. In these circumstances, refunds will not be given.
2.4 Personal Responsibility
Some coaching conversations, hypnotherapy sessions, guided visualisations and reflective exercises can evoke emotional responses.
You are encouraged to work within your own comfort levels, listen to your body and let me know if you need to pause, stop or take a break at any point.
You remain responsible for your own physical, emotional and psychological wellbeing throughout our work together.
3. ROOTS TO RISE® 1:1 COACHING & HYPNOTHERAPY
3.1 Payment & Commitment
Payment is required in full or via an agreed payment plan before your programme begins.
Where a payment plan has been agreed, you are committing to the full programme investment.
Payment plans must be completed in full, even if you choose not to complete the programme.
No refunds are offered for sessions attended, missed or partially completed.
3.2 Rescheduling
Appointments may be rescheduled with a minimum of 48 hours' notice.
Appointments cancelled with less than 48 hours' notice, or sessions missed without notice, will be treated as completed and cannot normally be rearranged.
Exceptional circumstances will always be considered at my discretion.
3.3 Programme Timeframe
Roots to Rise is designed as a complete transformational journey.
To gain the greatest benefit, sessions should be completed within the timeframe agreed at the point of purchase unless an alternative arrangement has been agreed in writing.
3.4 Hypnotherapy
Hypnotherapy forms one of many tools available within Blue Conker and is always optional unless specifically booked as a standalone service.
You must disclose any relevant medical conditions, diagnoses or medication before participating so that I can determine whether hypnotherapy is appropriate.
Whilst many clients experience significant positive change, individual outcomes cannot be guaranteed.
3.5 Recording Sessions
Unless agreed in advance, coaching and hypnotherapy sessions may not be audio or video recorded by clients.
Any recordings supplied by Blue Conker remain the intellectual property of Blue Conker and are provided solely for the personal use of the purchasing client.
They may not be copied, shared, reproduced or distributed.
4. GROUP PROGRAMMES, WORKSHOPS & LIVE SERIES
4.1 Group Dynamics
Respect for one another's identities, lived experiences and perspectives is essential.
Confidentiality applies to all group members.
What is shared within the group stays within the group.
Participation is encouraged but never compulsory.
You are always free to decline an exercise or choose not to share personal experiences.
4.2 Payments
All group programmes become non-refundable once the programme has commenced.
Where payment plans are offered, they represent a commitment to the full programme fee and must be completed in full.
5. DEFRAZZLE SESSIONS
5.1 Nature of the Sessions
Defrazzle Sessions are guided wellbeing experiences designed to help participants slow down, regulate their nervous system and reconnect with themselves through a combination of guided relaxation, mindfulness, breath awareness, journalling, creative activities, gentle movement and optional group reflection.
Defrazzle Sessions are educational and wellbeing experiences. They are not therapy, counselling, psychotherapy or crisis intervention.
Participation is always voluntary, and you are encouraged to work at your own pace.
5.2 Participation
You are always free to:
• pause an exercise
• take a break
• choose not to participate in any activity
• leave the room if you need to
• rejoin the group when you feel ready
You are encouraged to listen to your own body and honour your own boundaries throughout the session.
5.3 Respecting the Space
Defrazzle Sessions are built on kindness, curiosity and respect.
By attending you agree to:
• respect the confidentiality of other participants
• avoid judgement or unsolicited advice
• contribute to creating an inclusive and psychologically safe environment
• respect the diverse identities, lived experiences and perspectives of others.
Blue Conker reserves the right to ask anyone whose behaviour compromises the safety or wellbeing of the group to leave the session.
5.4 Booking, Cancellation & Transfers
Bookings may be transferred to another Defrazzle Session where a minimum of 48 hours' notice is provided and subject to availability.
Cancellations received with less than 48 hours' notice, or failure to attend, are non-refundable.
Should Blue Conker need to cancel or postpone a session, you will be offered either:
a transfer to an alternative session, or
a full refund.
6. ROOTS TO RISE WALKS
6.1 Nature of the Walks
Roots to Rise Walks are guided wellbeing walks designed to encourage connection, movement, nervous system regulation and community.
They are not guided hikes, fitness programmes or clinical interventions.
6.2 Participation
You attend entirely at your own risk and are responsible for ensuring you are physically able to participate.
Please wear suitable clothing and footwear appropriate for the weather and terrain.
If you have any concerns about your health, please seek appropriate medical advice before attending.
6.3 Weather & Safety
Walks may be postponed, amended or cancelled where weather or environmental conditions make it unsafe to proceed.
If Blue Conker cancels a walk, you will be offered either an alternative date or a full refund.
7. ONLINE COURSES & DIGITAL PRODUCTS
7.1 Personal Licence
When purchasing an online course or digital programme, you are purchasing a personal licence to access the content.
Your access is for your own personal use only and must not be shared with any other person.
7.2 Cancellation Before Access
If you purchase an online course but have not accessed any module, lesson, video or downloadable material, you may request cancellation within 14 days of purchase.
A £20 administration fee will be deducted from any refund.
7.3 No Refund Once Accessed
Once any part of the course has been accessed, viewed, downloaded or opened, the course becomes non-refundable.
This includes purchases made using a payment plan.
Beginning a course confirms your commitment to complete all outstanding payments.
7.4 Payment Plans
Where payment plans are available, these represent a commitment to the full course investment.
Stopping participation does not cancel your payment obligations.
Missed payments may result in temporary suspension of access until payments are brought up to date.
7.5 Sequential Learning
Some Blue Conker courses have been intentionally designed as progressive learning experiences.
Where applicable, course exercises must be completed and submitted before subsequent modules are released.
This structure forms part of the learning process and allows knowledge to be explored, reflected upon and integrated before moving forward.
7.6 Course Development
Blue Conker continually reviews and improves course content.
I reserve the right to update, amend or improve course materials at any time to reflect new learning, legislation, research or best practice.
Such changes will not reduce the value of the course purchased.
8. FREE RESOURCES
8.1 Newsletter
By subscribing to the Blue Conker newsletter you agree to receive educational content, reflections, updates, invitations to events, new services and occasional promotional emails.
You may unsubscribe at any time using the link provided within each email.
8.2 Positivity Challenge
The Positivity Challenge is provided as an educational wellbeing resource.
It is designed to support personal reflection and positive habit formation but should not be considered therapy, counselling or medical advice.
8.3 Other Free Resources
From time to time Blue Conker may provide downloadable guides, workbooks, videos, recordings or other digital resources.
Unless otherwise stated, these remain subject to the same copyright and intellectual property protections outlined in these Terms.
9. COPYRIGHT & INTELLECTUAL PROPERTY
9.1 Ownership
All Blue Conker content remains the intellectual property of Blue Conker unless otherwise stated.
9.2 Protected Materials
This includes, but is not limited to:
• Roots to Rise®
• the Roots to Rise® framework and methodology
• coaching frameworks
• online courses
• workbooks
• worksheets
• videos
• audio recordings
• hypnotherapy recordings
• guided meditations
• presentations
• graphics
• journals
• journal prompts
• emails
• PDFs
• written materials
• creative exercises
• digital downloads
• website content.
9.3 Copyright
The Roots to Rise® framework, accompanying materials, exercises, recordings, written content and methodologies are protected by UK copyright law.
No part of any Blue Conker programme may be copied, reproduced, adapted, distributed, shared, recorded, resold, taught or incorporated into another programme, training or business without prior written permission.
9.4 Client Use
Course access and programme materials are licensed solely to the purchasing client.
They may not be transferred, shared or reproduced in any format.
10. PRIVACY & GDPR
Blue Conker complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
10.1 Information Collected
Depending upon the service provided, I may collect:
• your name
• contact details
• email address
• payment information
• emergency contact details where appropriate
• relevant health information voluntarily disclosed
• coaching notes
• course progress information
• correspondence relating to your services.
10.2 How Information Is Used
Your information is used only to:
• deliver coaching, hypnotherapy and educational services
• communicate with you
• process payments
• deliver newsletters where consent has been given
• meet legal obligations
• improve the quality of Blue Conker services.
Your information will never be sold to third parties.
10.3 Your Rights
Under UK GDPR you have the right to request:
• access to your personal information
• correction of inaccurate information
• deletion of your information where legally applicable
• withdrawal of consent where processing relies upon consent.

10.4 Data Storage
All personal information is stored securely using appropriate technical and organisational measures designed to protect your privacy.
11. LIMITATION OF LIABILITY
11.1 Personal Responsibility
Your agency is central to our work together.
Whilst I provide guidance, education, support and professional expertise, you remain responsible for your own decisions, actions and wellbeing during and following our work together.
11.2 Outcomes
Blue Conker cannot guarantee specific personal, professional, financial or health outcomes arising from participation in any service or programme.
11.3 Liability
To the fullest extent permitted by law, Blue Conker shall not be liable for any indirect, consequential or incidental loss arising from participation in any service or programme.
Nothing within these Terms excludes liability where it cannot legally be excluded.
12. GOVERNING LAW & COMPLAINTS
12.1 Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
12.2 Complaints
Should you have any concerns regarding the services provided, I encourage you to raise them with me in the first instance so that we can seek to resolve them promptly and professionally.
Where matters cannot be resolved informally, they shall be subject to the jurisdiction of the courts of England and Wales.
